• Allgemeine Liefer- und Leistungsbedingungen
  Abweichende Bedingungen des Bestellers sind unwirksam, solange sie nicht von uns bestätigt sind.
• Lieferung
  Lieferbedingung: CIP. Im Falle des Lieferverzuges ist der Auftraggeber auch zur Abnahme von Teillieferungen verpflichtet. Die letzte Teillieferung hat spätestens 30 Tage nach dem vereinbarten Liefertermin zu erfolgen. Der Auftraggeber ist zum Rücktritt vom Vertrag wegen Nichteinhaltung der Lieferfrist erst dann berechtigt, wenn er dem Auftragnehmer mittels eingeschriebenen Brief eine angemessene Frist gesetzt hat. Als angemessen gilt eine Frist von 6 Wochen. Schadenersatzansprüche wegen Verzuges sind ausgeschlossen.
• Gewährleistung
  Die Gewährleistungsfrist beträgt, sofern nicht anders vereinbart, 12 Monate. Gewährleistungsverpflichtungen bestehen nicht, wenn der Mangel auf eine unsachgemäße Benutzung, Pflege, Weiterverarbeitung oder auf gewaltsame Einwirkung zurückzuführen ist. Garantieleistungen werden durch den Hersteller erbracht.
• Zahlungsbedingungen
  Zahlung erfolgt auf Grundlage eines unwiderruflichen, bestätigten Dokumentenakkreditivs (Letter of Credit), per Nachnahme, Vorkasse oder elektronischen Zahlungsverkehr. Alle Rechnungen für Lieferungen, Teillieferungen und Leistungen sind, falls nicht anders vereinbart, sofort nach Rechnungserhalt und ohne Abzug zu zahlen.
• Schlussbestimmungen
  Alle Urheberrechte verbleiben beim Auftragnehmer, die Vervielfältigung der Ware ist nicht erlaubt. Die ausgelieferte Ware bleibt bis zur vollständigen Bezahlung Eigentum der Goldschmiede. Es gilt das Recht der Bundesrepublik Deutschland. Erfüllungsort und Gerichtsstand ist Leipzig.

Business Conditions

Deviating terms and conditions of the orderer, hereinafter called party to the contract, are invalid, as long as they are not  confirmed by the Garcia manufactury, hereinafter called company.
Orders or contracts are not accepted, unless the company affirmed them in writing.

Prices and Conditions of payment

Delivery shall be effected at customer´s expense "ex works" from Saxony. If there should be a price increase in material between the day of the order acceptance and the day of delivery the company reserves the rights to adjust prices adequately.Conditions of payment are included in the order confirmation.

Delivery Conditions

In case of delay in delivery the party of contract shall be entitled to effect partial shipments. The last part-delivery has to be taken place at least 7 days after the agreed delivery date.  If the company fails to meet the delivery conditions the party of contract can withdraw from the contract as long as he has given the company an adequate fixed time limit to meet the requirements by registered mail.
A set target of 2 weeks applies to be adequate.
In cases where the customer can assert that there is no longer an interest in fulfilment of the contract as a result of the delay in delivery caused by us he cannot claim any damages. Delivery takes place at the latest 2 days after the receipt of payment. Goods left with the customer at his request on option are deemed definitely sold if  they are not returned within 7 days after the period having been agreed upon by us in the accompanying documents. If any of the samples have been purchased by the party to the contract then he only has to bear the costs for the return postage. If all samples are returned the party to the contract has to bear the full postal charge. The return transport of the delivered samples has to be insured by the party to the contract.

Warranty

Obvious defects shall be announced in writing within 7 days after delivery of the goods at their destination. Claims for damages cease to exist when the defect is caused due to improper use, care, processing, misuse because of not attending enclosed service instructions, or violent actions. Warranties are matter of the company.

Maintenance and Repair

Items from the Garcia Collection which need repairing are compensated with a package price of € 50,00 plus insurance, packing and shipping. For unique items commercial commitments made in the jewellery certificate are binding.
Annually, the company offers a free cleaning for all purchased items from the Garcia Collection which were sent to the party to the contract and are still part of stock. Insurance, packing and shipping have to be paid by the party to the contract.

Payment conditions

Payment takes place on the basis of a irrevocable confirmed letter of credit, on delivery, by cheque or by prepayment. All invoices for delivery, short delivery and service are payable stricltly net upon receipt unless otherwise agreed. The mode of payment is each agreed in the order confirmation. Basically the order confirmation is arranged as a pro-forma invoice. According to the period fixed the payment receipt involves the merchandise delivery to the forwarder.

Final provisions

All copyrights remain with the contractor, dublication of products is not permitted. Specimen, blueprints, designs or models are also without any design protection ownership of the company. All delivered goods are property of the company until they have not been fully paid. The company is entitled to process and use all data correlated with customer relations within the meaning of the Federal Data Protection Act.
The contract is subject exclusively to German law and German Business conditions. The place of performance and jurisdication for both parties is Leipzig; The court of jurisdication shall be the responsible court in Leipzig.
